There are a number of actions that need to be taken following a death. This process is called ‘executry or estate administration’. How the estate is dealt with will depend on whether there is a will, the size of the estate, the types of asset and who is to benefit.

In Scotland, an executor often needs to obtain Confirmation (known as ‘probate’ in England) before they can access the deceased’s assets and wind up the estate. We can explain all the steps that need to be taken and offer advice and guidance at every stage, including:

  • clarifying an executor’s duties
  • identifying the nature and extent of the deceased’s assets and debts. For example, there might be a house, bank accounts, car, pensions, shares etc
  • obtaining Confirmation from the Sheriff Court
  • completing any forms and other paperwork required by the courts and agencies such as HMRC
  • gathering and then distributing the estate to the correct beneficiaries
  • preparing estate accounts
